Palma, June 2026 — Spain’s yacht charter market requires compliance with specific regulations before any recreational vessel can operate commercially. Following the entry into force of Royal Decree 186/2023, Evolution Yacht Agents reminds yacht owners, fleet managers and charter operators of the importance of understanding and correctly applying the two clearance procedures established under Spanish maritime legislation.
Two routes, one objective: legal compliance
Royal Decree 186/2023 establishes a clear framework with two distinct regimes: clearance by express authorization and simplified clearance through a responsible declaration. The applicable route depends on the vessel’s flag, operational history and the nature of the intended itineraries.
Express authorization is the mandatory procedure for the first clearance of any recreational vessel wishing to operate commercially as a charter yacht in Spanish waters, regardless of whether it flies an EU or non-EU flag. Although it is a one-time entry process, it entails ongoing compliance obligations, including valid technical and safety certificates, commercial-use inspections carried out by authorized bodies, mandatory third-party liability insurance and accident coverage for everyone on board, as well as a management agreement with a duly authorized charter company.
This authorization is valid for a maximum of three months per calendar year and may be suspended or revoked if any significant changes occur in the technical, operational, insurance or management conditions under which it was granted.
Simplified clearance through a Responsible Declaration is available only after the vessel has completed the full first-clearance process. Under this regime, the vessel may operate by submitting a Responsible Declaration confirming that all seaworthiness requirements, insurance policies, crew qualifications and regulatory obligations continue to be fully met.
